Flock Is Changing the Rules

New safeguards are coming to Flock's license plate camera network

Flock Safety, the company behind the license plate-reading cameras popping up across Florida and the country, is making some significant changes to how its system can be used. And considering the privacy debate surrounding these cameras, the changes raise a pretty reasonable question: Why weren't some of these safeguards required from the beginning?

Flock cameras photograph passing vehicles and make information like license plates available through a searchable database used by law enforcement agencies. Police say the technology has helped locate stolen vehicles, find missing people and track suspects. That's the upside.

The concern has always been what happens when someone with access decides to use that enormous database for something other than fighting crime. A Washington Post investigation identified at least 50 law enforcement officers accused, charged or convicted of misusing Flock or other license plate-reader systems, including allegations involving officers searching for girlfriends, ex-wives and other people for personal reasons.

Now Flock is tightening things up. Beginning next year, officers will generally have to associate searches with criminal case numbers. Multifactor authentication will become mandatory, automated auditing will look for suspicious activity, and Flock is recommending that agencies reduce the default period they retain data from 30 days to seven.

Those all sound like pretty sensible precautions. Which is exactly why it's worth asking why they weren't standard already. Some safeguards were previously available but optional. According to The Washington Post, Flock's automated auditing system was being used by only about a third of its roughly 7,000 law enforcement customers.

And that's really the bigger conversation for communities like Wesley Chapel. License plate readers can be incredibly useful tools. But useful technology still needs guardrails, especially when that technology can create a searchable record of where ordinary people have traveled.

Flock deserves credit for responding to those concerns and strengthening its safeguards. But when mandatory audits, case-number requirements and shorter data retention arrive after thousands of agencies are already using the network, it's fair to wonder whether we're putting up the guardrails after we've already opened the highway. Because if we're going to build technology capable of watching everyone, we'd better be equally serious about watching the people using it.
